Cyber AI User Agreement

Version dated 21 September 2026. Published at https://cyhub.ai/en/terms-of-use.

1. General

1.1. This Agreement sets the rules for using the Cyber AI service (the "Service") available at https://cyhub.ai, via the Telegram bot https://t.me/gptcyber_bot and the MAX bot https://max.ru/id301612809292_bot. The Service is operated by Oleg Galitchii, an individual, Republic of Moldova (the "Operator").

1.2. The Agreement applies to everyone who uses the Service, including free features. Paid services, Wallets, prices and refunds are governed by the Terms of Service (https://cyhub.ai/en/terms). Personal data is governed by the Privacy Policy (https://cyhub.ai/en/privacy). On payment and refund matters the Terms of Service prevail.

1.3. By starting to use the Service (the /start command in the bot, signing in on the website, pressing the acceptance button) the User confirms that they have read and accept this Agreement. A User who disagrees with any provision must stop using the Service.

1.4. The Service is intended for persons aged 18 and over. By using the Service the User confirms their age.

1.5. The Service interacts with the User by means of artificial intelligence. The texts, images, videos and audio the Service produces are generated automatically by third-party generative AI models.

2. Account

2.1. An Account is created automatically on the first interaction with a bot or sign-in on the website and is linked to the User's Telegram or MAX identity or website login. One person, one Account per platform. The Operator may offer a way to link Accounts across platforms.

2.2. The User keeps access to their messenger and website Account secure. Actions taken from the Account are deemed the User's until they report a compromise to support.

2.3. Transferring an Account, Balance or access to the Service to third parties, including for payment, is not permitted. Sharing links to the Service and one's own Outputs is allowed.

2.4. The User may stop using the Service at any time and request deletion of the Account at info@cyhub.ai. Before deletion, unused paid Balance is refunded under the Terms of Service.

3. Acceptable use

3.1. The Service is intended for manual use through the bot and website interfaces. It is prohibited to:

3.2. The Operator may set technical limits: the number of concurrent requests, the size of uploaded files, request frequency. Limits are published in the Service.

4. Prohibited content

4.1. The User must not create, upload or request through the Service content that:

4.2. When uploading photos, videos or voices of people, the User warrants that these are their own materials or that they have obtained the consent of the persons depicted. Uploading photos of minors to face-swap and face-transfer features is prohibited.

4.3. The Service and the Models apply automatic filters. A request rejected by a filter without an Output is not charged. Filters can err in both directions; a rejection is not an accusation against the User, and passing a filter does not release the User from responsibility for the content.

4.4. EU AI Act. The User must not use the Service to generate intimate or sexually explicit content depicting an identifiable real person without their explicit consent, or any content sexualising minors, and must comply with the transparency obligations that apply to them when publishing AI-generated content (section 6).

5. Rights in materials and Outputs

5.1. Materials the User uploads (texts, photos, videos, audio) remain the User's property. The User allows the Operator, free of charge, to store, process and transmit them to Models to perform the User's requests and deliver Outputs. Model providers process the materials under their own terms, and some of them may also use them to train their models (list of providers: https://cyhub.ai/en/privacy/providers).

5.2. The Operator claims no rights in Outputs. To the extent rights arise in an Output under applicable law, they belong to the User. The User may use Outputs for personal and commercial purposes subject to the law and the terms of the Model developers.

5.3. The Operator does not warrant that an Output is protected by copyright: in many jurisdictions protection requires a human author's creative contribution. The Operator also does not warrant that an Output is free of resemblance to third-party works or that it is unique.

5.4. Outputs are stored in the Service and available for download for 30 days from delivery. Uploaded materials are deleted within the same period. The Operator does not use the User's requests, materials or Outputs to train models and does not publish them. Publication of an Output in the Operator's gallery or channels requires the User's separate consent.

5.5. Exclusive rights in the Service, its code, design, the Cyber AI name and interface materials belong to the Operator. Rights in the Models belong to their developers. No rights in the Service or the Models pass to the User beyond the right to use the Service as intended.

6. Marking of AI-generated content

6.1. The Service may add visible marks and machine-readable metadata to Outputs indicating that the content was created with artificial intelligence; Models may add such marks themselves. The Operator does not warrant that a mark is present in, or survives in, every file, including after messengers compress files and strip metadata.

6.2. The User must not remove, alter or hide such marks in order to present content as human-made or as an authentic record of real events.

6.3. When publishing Outputs that could be taken for authentic images of real people, events or places, the User discloses their AI origin where the law or the platform's rules require it. Under the EU AI Act, deployers who publish deepfakes must disclose that the content has been artificially generated or manipulated. The User may place their own AI notice on Outputs in any form; the recommended format is a text label "AI-generated".

7. Moderation, suspension and termination

7.1. For breaches of sections 3-4 the Operator applies measures proportionate to the breach: a warning, rate and volume limits, temporary suspension of particular features, or suspension of the Account.

7.2. The User is notified in the Service of the measure and its reason. A remediable breach is first notified with 5 business days to remedy. Immediate suspension without warning is permitted for content prohibited by law, fraudulent payments, attacks on the Service and a repeated breach after a warning.

7.3. Suspension does not forfeit the paid Balance. The unused part of the User's own payments is refunded under the Terms of Service, less documented losses caused by the breach. Bonuses are cancelled on suspension for breach.

7.4. The User may appeal a measure at info@cyhub.ai. A human reviews the appeal and replies within 10 days. If the measure was applied in error, access is restored, and there are no charges for the suspension period.

7.5. Third parties may report an infringement of their rights to info@cyhub.ai with a description of the content and the grounds. The Operator reviews such reports within 10 days.

8. Liability and limitations

8.1. The Service provides the technical ability to work with third-party Models. Outputs may be inaccurate, incomplete, outdated or unfit for a particular purpose and are not professional advice. The User checks Outputs before use and is responsible for decisions made on their basis.

8.2. The Operator is responsible for the operation of the Service and the correctness of charges as set out in the Terms of Service. The Operator is not responsible for the operation of Telegram, MAX, telecom operators or the User's devices, or for the content of the User's requests and Outputs.

8.3. The Service may be temporarily unavailable for maintenance. Planned maintenance is announced in advance. The User's Balance is retained during unavailability.

8.4. The list of Models and features may change: developers update, restrict and discontinue Models. The Operator aims to replace discontinued Models with comparable ones; the paid Balance is retained and may be refunded under the Terms of Service.

8.5. The User is liable to third parties for their requests, uploaded materials and the use of Outputs. If claims are brought against the Operator because of the User's breach of this Agreement, the User compensates documented losses within the limits set by law.

8.6. Nothing in this Agreement limits the rights of consumers under mandatory law, or the Operator's liability for death or personal injury caused by its negligence, fraud, wilful misconduct or gross negligence.

9. Personal data and confidentiality

9.1. Personal data is processed under the Privacy Policy (https://cyhub.ai/en/privacy). Consent to processing that is not necessary for the Service is given by a separate action and is not a condition of access.

9.2. Requests and uploaded materials are transmitted to Model developers, including outside the User's country, to perform the request; the developers process them under their own terms, and some of them may also use them to train their models (list of providers: https://cyhub.ai/en/privacy/providers). The User should not include in requests information they do not wish to share with third parties: passwords, payment details, identity documents, medical information.

9.3. The Operator does not manually review the User's requests and Outputs except when handling the User's own enquiry, verifying a report of a breach, or as required by law.

10. Changes

10.1. The Operator may amend this Agreement. The new version is published at https://cyhub.ai/en/terms-of-use with its date, and material changes are announced in the Service at least 30 days before they take effect (10 days for changes required by law or security).

10.2. A User who disagrees with the new version stops using the Service and may receive the unused paid Balance under the Terms of Service.

11. Final provisions

11.1. This Agreement is governed by the laws of the Republic of Moldova. A consumer habitually resident in another country also enjoys the protection of the mandatory law of that country and may bring proceedings in its courts; the Operator may sue a consumer only in the courts of the consumer's country of residence.

11.2. Enquiries about the Service are accepted via /paysupport in the bot and at info@cyhub.ai. The reply period is 10 days.

11.3. If any provision is held invalid, the remaining provisions continue in force.

11.4. Operator: Oleg Galitchii, Republic of Moldova, info@cyhub.ai.
